Freelancers, agencies and SaaS founders in India often form a U.S. LLC to invoice American clients, accept payments through U.S. platforms and present a U.S. presence. The U.S. side is straightforward; the Indian side deserves just as much attention.
The order of steps
- Choose a state — most Indian founders operating remotely pick Wyoming or New Mexico.
- Form the LLC and appoint a registered agent.
- Get an EIN using Form SS-4.
- Open a U.S. business bank account.
- Connect payment platforms.
Questions to settle in India
- How overseas investment in your own company is reported under Indian foreign-exchange rules.
- How the LLC’s income is taxed in India, and whether the company could be treated as managed from India.
- How you will move money from the LLC to yourself.
Speak with an Indian chartered accountant before you form, not after. The U.S. structure is easy to set up; the cross-border reporting is where mistakes are expensive.
